Stones being sued for concert cancellation

Woman to sue Stones for scrapping show

Rosalie Druyan wants to stick the Rolling Stones between a rock and a hard place with a $US51 million ($A66.37 million) lawsuit.

Shattered when Mick Jagger's sore throat scrapped the Rolling Stones concert in Atlantic City - four hours before its scheduled start - the Stones superfan from Brooklyn is taking the wrinkly rockers to court.

In a class-action suit to be filed in Manhattan Supreme Court, Druyan contends the late cancellation cost her and other fans big bucks on non-refundable hotel reservations, forcing them to spend the night together in cold and rainy Atlantic City.

"Talk about no satisfaction," quipped lawyer Martin Druyan, who is representing his wife in the case.

The Stones - who are set to play the Beacon Theatre on Tuesday night for a Martin Scorcese concert film on the legendary band - cancelled their show at Boardwalk Hall when Jagger came down with a sore throat. But the bad news didn't come soon enough for Rosalie Druyan, who last month had bought a pair of tickets to the show for $US575 ($A748).

"People came from all over to see the Stones," she said.

"When you talk about travel expenses, hotel and baby-sitting expenses, that's not a cheap day."

Druyan said she received a Ticketmaster e-mail on her BlackBerry notifying her of the cancellation when she was a few kilometres from Atlantic City. By then it was too late to cancel a $US300 ($A390) reservation at the Trump Taj Mahal and too rainy to drive back to Brooklyn.

"We were bored for nothing," said Druyan.

The Stones announced that another Atlantic City concert will be held on November 17 and that refunds are available for ticket holders who can't make that date.

But Druyan and her husband, who have attended nearly 50 Stones shows between them, won't be among those going back to Atlantic City. A spokeswoman for the band was not available for comment.

"We're real Stones fans, and we see them everywhere," Rosalie Druyan said.

"But we won't be seeing them at the make-up concert."

Can they actually sue the Stones for canceling? They are refunding the tickets and didn't tell people that they have to get expensive hotels and such. Not saying that it doesn't suck that she lost all that money, but can they actually sue for this?

You can sue anybody, but they doesnt mean you will win. I say good for her. It cost me over $600 in a hotel, gas, 2 days vaction. I will testify. BUT, i will also be there on the 17th.

I may be a minority here, but I'm wondering why she's sueing for $51 million for a $300 hotel room? Was she that miserable that her misery is worth almost $51 million? Seems a little steep to me.
Or maybe I'm not understanding the article properly

Yes, losing time, anticipation and money for airfares, travel and hotel expenses is a drag. I know; I've had it happen.

Still, anyone who can come up with the dough surely has to know that there are no guarantees in life or with a touring band.

The cold night air of recent Stones gigs hasn't been a plus for the lead singer's voice. Then there's Keith shaking with cold in Chicago.

Maybe the problem is that some fans have a problem admitting the Stones are human beings.

If the "Show must go on " , as they say and Mick stunk up the place because of a poor delivery . WOULD YOU SUE THE STONES THEN ?

You know what....she's a twat! I spent the same $$ she spent getting there for gas from Chester Co in Pennsylvania, we also spent an "unnecessary" night at the Trump Marina Hotel & Casino and got the news too late to cancel the hotel. I was with friends and while we were very dissapointed, shit does happen, shows get cancelled, people get ill, people fall out of trees, you name it.....

But if that's the first cancelled concert that's ever happened to her then she's been pretty lucky. But to sue??!! jeezus! that's a little extreme isn't it. And if she doesn't want to pay for another hotel room then drive home...Brooklyn isn't exactly hours and hours away!!

I'm not defending the Stones if they cancelled 'cause of the Beacon gig...but in court, I'm sure old Mick will be able to produce a "doctor's note". Frankly, it'll cost more much $$ to file a class action suit than she spent on getting to the show!! Christ in a sidecar, get a little perspective lady!

I don't know wghat the rate was for her lodging @ The Trump Hotel . But if you shopped around you would not feel like such a fool ( twat ) . I paid a mere $45.00 US for a nice room in Somers Point , NJ 10 miles south of AC . Use your heads and save some $$$$$$$$$$.

People like this make me sick. Taking simple misfortune and elevating it to a level of legal entanglement is inexcusable and does not generate further sympathy - it only provokes anger and resentment. The lady and her shyster husband deserve to be at the bottom of the Hudson

She will lose, it was her choice to book a room, travel, etc. It sucks being in that situation but that is how the law will see it. If the band were to refund her travel, hotel, etc...the claims would never end.

I think Streisand fans who saw her Final Concert years back should have pressed hard and had a class action suit. Her programs, passes, etc all said Farewell, Final and so on. Selling a tour as if would be the "last time" was misleading and fraud. Anyone who still had a ticket stub should have made a claim for just the face price of the ticket.

If a Doctor advised Mick not to do the gig, then there would be no chance to come thru' with such a sue atempt - at least in germany.
