Rolling Stones, Lil Wayne Lawsuit Settled

A lawsuit filed over Lil Wayne's alleged use of the Rolling Stones's song "Play With Fire" was settled today.

Abkco Music Inc, which owns the rights to a portion of the Rolling Stones catalog, filed suit against UMG Recordings, Inc., Warner/Chappell Music, Inc., EMI Group, LTD. and other parties, including Lil Wayne (real name Dwayne Michael Carter) in July of last year, claiming copyright infringement and unfair competition.

Lil Wayne's "Playing with Fire" was a clear derivative of the Rolling Stones song with the original lyrics and music altered in a recognizable way, Abkco said in its lawsuit, according to Reuters.

Prior to the settlement, the disputed recording was voluntarily removed from "Tha Carter III" and taken down by all providers of digital downloads, ringtones and ringbacks, according to a release issued today.

The announcement states "all parties expressed themselves satisfied with the amicable settlement."

(antiMusic) Remember that lawsuit over Lil Wayne's usage of the Rolling Stones' classic "Play with Fire?" it appears that the matter has been settled; we received this rather businesslike statement:

ABKCO Music Inc, UMG Recordings, Inc., Warner/Chappell Music, Inc., EMI April Music, Inc. and other parties, including Dwayne Michael Carter, p/k/a Lil Wayne, announced the settlement of all claims asserted in the litigation between the parties commenced, in July, 2008, by ABKCO in the United States District Court for the Southern District of New York.

In the litigation, ABKCO had sought, among other things, injunctive relief and damages arising from ABKCO's allegation of infringement of ABKCO's Rollng Stones' composition "Play With Fire" by the Lil Wayne recording "Playing With Fire" which was originally contained in the album "Tha Carter III." The defendants, who are parties to the settlement agreement, had denied ABKCO's allegations in the litigation.

Prior to the settlement, the disputed recording was voluntarily removed from "Tha Carter III" and taken down by all providers of digital downloads, ringtones and ringbacks.

Pursuant to the terms of the settlement agreement, the parties agreed not to claim that the composition embodied in the disputed recording constituted an independent copyrighted work or a derivative work of ABKCO's composition under the copyright laws of any country.

The terms of the settlement are governed by a confidentiality agreement.

All parties expressed themselves satisfied with the amicable settlement.

Lil Wayne's "The Carter III" is only the biggest selling album in the United States for 2008.

Interesting that ABKCO sued UMG- presumably the Universal Music Group, which distributes ABKCO's product.

Don't think so. Allen Klein only ever defended ONE person's interests : himself.
I bet he owns the rights to this song = he'll get all the pie.

Much like what happened to The Verve with their song "Bittersweeet Symphony" which included a 15s sample of a symphonic of "The Last Time" : AK jumped on them and demanded 100% of the songwriting rights for BS. Not a cut, not a few %s, the whle lot...

I´m not anti-hip-hop/rap at all and there is some really good (non-mainstream) stuff out there but this crap speaks for itself.

Klein's ABKCO own's the publishing rights but this song is actually a Nanker Phelge credit (not just Jagger/Richard) so all of the Stones (including Brian's estate?) should get royalties from Lil Wayne's version after Klein gets his cut.
Similar situation with The Verve. ABKCO owns the publishing rights but it's still a Jagger/Richard composition so they all would have benefited financially.
I'm wondering if any of the Stones would have known about the Lil Wayne song if ABKCO hadn't filed the lawsuit.

That's not the official version....some fan on YouTube screwed with the audio thereby creating this "remix" meanwhile..I can't find the official version of Lil Wayne's song..

Lil Wayne is quite popular right now. Although I'm not a big fan of his music or the image he projects, things could be much worse. At least he's legitimately earning a living.
