JJFLASH / KINKS CATCH ME NOW I'M FALLING

Does anybody know if Klein/Abkco brought a law suit against Ray Davies/The Kinks for the blatent rip off of the Jumping Jack Flash riff in the Kinks song "Catch Me Now I'm Falling"?

Just curious as I was listening to the LOW BUDGET Cd recently.

For Kinks fans...forgot how good this CD is...Superman, National Health, Catch Me, Low Budget etc.

I mentioned this song in the Ray Davies thread - yeah, same guitar lick (standard tuning though - kinda like Frampton's version). They also "borrow" from the Beatles and themselves. I think Ray said, "If you're gonna steal, steal from the best".

Yeah I brought this up several months ago when we talking about rip off songs.


Another one I've brought up previously. The Steve Miller Band song,The Stake. The guitar riff is a blatant rip off of the Joe Walsh classic,Rocky Mountain Way.....I always thought Steve should of called the song Rocky Mountain Stake.

A Gallon Of Gas off of Low Budget is one of my favorite Kink songs with lyrics as relevant today as they were in 1980; not to mention that Dave absolutely tears it up on the blues guitar.

It would have been Abkco (Allan Klein) on behalf of itself and the writers (Mick and Keith).
The publisher as the copyright owner has the right to sue.

If you knew anything about music and/or guitar riffs/licks,
the similarities are obvious.

But here's another one for you to ponder. The Doors' Hello, I Love You is a direct ripoff of the Kinks' All Day, And All Of The Night.
I think there was even a lawsuit against the Doors which was settled out of court.

Right about it being a rip-off but Ray never would have tried to get away with it by doing it underhand. It is just too obvious.

Sometimes it´s forgotten Ray Davies is not only one of the most sensible people in rock biz, but also has a wonderful sense of humour - just lsten to him quoting the KINKS´ "All DAy..." on "Give The People What They Want" (Song "Destroyer")

And I hope you all noticed Ray has an album out for more than a year now that is BRILLIANT (Other People´s Lives)

Im sure you don't know a thing. First of all Jet Airliner is in the key of F. Crossroads is in A. All Right Now is in A, Keep On is in Bb. Hello I Love You and All Day only have the first two chord alike along with 10,000 other songs. It's like me saying that two people look alike becasue the have two eyes and a nose! Put your hearing aid in and learn how to play an instrument. next thing you'll be telling us that Night in White Satin sounds like Monkey Man.

Regardless of what key those tunes are in, the fact is they are very similar.

Here's another for you...

George Harrison was sued when he released My Sweet Lord because it sounded too close to He's So Fine recorded by the Chiffons.
He lost the case, and paid a huge sum of money because the judge said they were virtually identical.
I wouldn't go that far to say they are identical, but the similarities are obvious if you listen to them back to back

the judge belived that Harrison did not copy yhe song, but felt that it was too popular for him to not have heard and therfore "subconsciously" he plagarized it! An impossible standard to rebut.

Wheh I studied copyright in law school the teacher played these two soings for us and asked us who thought they were the same (I did) and so did half the class. he said that every year it was split 50-50 when he asked the class, which shocked me because i think they are the SAME song.

haa, funny how these things go...
townshend has raved publically and admiringly in track by track interviews when the Who's first greatest hits comp. was released, very proud of himself proclaiming it can't explain was the best 'kinks' cop in history etc!!!...

he was straight out about it...and verry proud of himself...used the word "Exact!!" several times about copping it...hawww...not exactly hiding it...good for pete.

i did notice this when album w/ when catch me now i'm falling album first came out years ago...it was totally overt to me...
i didn't really want to join in the discussion considering where the stones have 'picked up' some of their EXACT riffs...and many brilliant deriviatinos thereof...

so i guess that's about a 3 billion dollars coming to chuck...and taylor and wyman need some checks in the mail too i suppose...fien with me...don't theenk that's the way it works tho...(tho it sure does get a lot of thread attention from time to time...debating who contributed what particular signature riff on whichever song or album etc...

i'm sure grateful to Bill for writing it tho! winking smiley

I don't see or hear the simialarities between Hardway and Can't Explain. But the JJf CMNIF connection has been talked about for years.

Why is it always necessary to state that your opponent is a total moron just because you don't see eye to eye over whether one song sounds like another or other trivial matters (Comparing albums or rating concerts).

Boys and girls - we wanna see a good CLEAN fight!!
