ABKCO had youtube remove my 'Satisfaction' video
Date: December 29, 2007 10:56

Check out this e-mail I received:

YouTube | Broadcast Yourself™
"Dear Member:
This is to notify you that we have removed or disabled access to the following material as a result of a third-party notification by ABKCO claiming that this material is infringing:
Rolling Stones Satisfaction Frankfurt Germany 6/13/07"

I uploaded a clip of Satisfaction from the Frankfurt show B-stage.
I was very close to the B-stage and the clip came out ok and it had over 15,000 views.

If it's footage I shot from my simple point and shoot camera and I'm not selling it, how is it copyright infringement?

I did a search on youtube for 'Rolling Stones Satisfaction' and it came up with 837 videos. Many of those videos are from copyrighted TV shows/performances while others were shot by fans at concerts.
There are uploaded clips from "The Biggest Bang" on youtube...now that's copyright infringement as that DVD is copywritten and is for sale.

Also, speaking of Satisfaction, this clip is apparently the first known live performance of the song. Brian even played harmonica in this version.
Dig the go-go dancers in the back!

it's worth reading that all the way through. (go VoodooChile!)

Isn't this Jagger singing over the demo version?

>> Isn't this Jagger singing over the demo version? <<

sure looks that way to me - ah, here it is from nzentgraf.de:

1965 20th May: US TV (ABC) 'Shindig!', Los Angeles. Host: Jack Good.
- Down The Road Apiece (Don Raye) - live
- Little Red Rooster (Willie Dixon) - live vocals on prepared backing track
- interview with MJ & BJ
- The Last Time (MJ/KR) - live vocals on prepared backing track
- Play With Fire (Nanker Phelge) - live vocals on prepared backing track
- Satisfaction (MJ/KR) - mimed to rejected version I from Chess 10th May 1965

Note: Telecast on the 26th May.
The backing tracks to which the Stones were miming to
were recorded two days prior to the telerecording at RCA Studios, LA

(i guess that note applies to the tracks apart from Satisfaction ... )

Matching music and images is called "synchronization"; in order to carry out this kind of action you need the consent of both the owner of the recording you want to use and the owner of the publishing rights of the song.

In this case, I think ABKCO called for copyright infringment as the publisher of the song, so it isn't really relevant that the footage is yours.

I think that's it.

Thanks, that makes sense.
Just curious as to why they care if I'm not making money off of it and why they leave the other 837 vids on youtube that are from actual copyrigted programs?

Thanks. Yeah I received my e-mail from ABCKO via youtube on the same day, December 7th, a day that will live in infamy.
I finally got around to checking e-mail as I've been recovering from knee surgery and on heavy medication.
I guess we should be flattered that a big publisher feels threatened by a few fans with cameras huh?
:-)

Yes, read the rocks off thread and saw the date of the post matched the date of the email I received....I just finally got around to noticing my video was removed 22 days ago. No more heavy meds, just tylenol extra strength...eating them like PEZ candy.

One of my Hungarian pals lost his account.
Rules are clear, but how they are followed is like hazardous.

I cant possibly imagine how any company could lose one single Cent from the tube.

This is all sadly familiar to me...

I'm glad that VoodooChile persisted & prevailed. Abkco had youtube remove the "shine a light" trailer (almost 80,000 hits!) that I posted for some reason... but I'm not inclined to challenge their claim, because I think that copyright issues might arise with other videos that I put on youtube.

it may signal the end of the world as we know it ... one day, these big corporations will control everything - including each and every corner of the Internet. just wonder when this day will come.

Thanks sssoul!

Yes, I won but in this case because they don't own the copyrights of neither the footage nor the audio I added, the only thing there owned by the bastards is the cover of Ya Ya's Out but I didn't used the cover but used DIGITAL ART inspired on the cover LOL. In fact I am giving a lot of exposure to Ya Ya's as it is written at the beginning "Why Ya Ya's is the greatest live album ever" so I am giving free publicity to the greatest thieves on Rock History! My video had more than 1.88 million views and was the number one for both "Rolling Stones" and "Jimi Hendrix" searches

Now it has a bug but will be restored soon, the first days of January

I am going to make a research about how the people think about ABKCO and Allen Klein, will start with how Allen thinks about himself LOL, then musicians and then the fans so if you want to comment something about the bastard feel free to do it. Once I finish the video it will be uploaded on YouTube with a lot of tags and as a reply tomy video that now has more than 1.9 million views.

Once my account was reinstated I immediately deleted the videos of Mexico City 2006 with songs owned by ABKCO, like Jumping Jach Flash and a smoking version of Midnight Rambler but left the others, probably will reupload them later with no tags and links on Gazza’s setlist page so it will be really hard to find by the ABKCO thieves

After all I don’t know why they complain, there’s a proverb that goes like this “Thief who steal another thief has 1,000 years of forgiving”

They already stole “legally” millions of dollars to the Stones and other bands, and now they are shaving YouTube, burn in hell ABKCO, Allen and Jody, probably your money will help there as hell is full of lawyers!!

ABKCO are dealing with these 'days of the internet' in the totally wrong way. The problem right now is that people are downloading official material...usually as MP3s.
Doing what ABKCO does, about innocent youtube-uploads, makes even righteous people so furious about the big people in record industry, that illegal downloading will seem like a "satisfactory revenge", even to them.

even guitar teachers on youtube can't explain Stones songs. I've just found this on
justinguitar, because somebody wants a "Paint it black" lesson:

"I can't do any Stones. sorry.

I was in a Stones tribute band for years and know the stuff really well...

but they have a mob of evil lawyers who sue and close anyone who infringes on their stuff...

they were the reason that next level guitar got pulled from youtube.

so the stones are off limits... along with prince...

sorry, J"

There needs to be something of a different name to put the videos up, something ABKCO are too stupid (as if we can expound upon that) to figure out like Blue Monday And The Cockroaches.

I don't see how ABKCO can make someone who shot a video on their cell-phone be a part of copyright infringment. How is that infringement? Because it sounds like The Rolling Stones? If there is no money being made and it actually IS The Rolling Stones then there is no infringement.

If ABKCO thinks they can get all the videos of the ABKCO Music songs for some pay to watch thing they won't make any money - it's the Internet.

Although its really stupid to pull the stuff, it's been a trend for entities owning copy written material to remove things. The artists formally known as prince that became artist known as a symbol then known as prince again has gone after Youtube for the exact same reason.

I'm kinda torn on this issue. The fan that uploads a video of a live performance is posting a free advertisement of the artists work. There are plenty of youtube clips that have comments like "I did not even know X was still playing" or my favorite "I thought X was DEAD". Youtube keeps an artist fresh in the minds of fans. As long as the fan is not profiting from the upload, I personally don't see the problem.

It gets a bit sticky when clips from Shine a Light (or other movies, TV shows etc) gets uploaded. The movie was created for one (REAL) purpose... To make the Rolling Stones money. Someone creative enough to record the Beacon shows on their mobile phone? Bring it on. It will not be able to complete with the video or audio qualities of the movie, an amateur clip is just a vehicle to share a moment in time from a fans perspective.

A great clip by the way.

As trivial as this incident might seem, I actually find it quite worrying that internet activities are now being policed like never before.

The age of the "internet as liberator" is coming to a close.

...and faster than we think.

Youtube is privately controlled and must adhere to the dictates of the market. You can post just about anything anywhere just as long as it's yours to post.

You tube is a great vehicle to keep idea's and content alive. Some however, take issue when the content is there's.

The liberator is still very much alive and well.

I hope you're right CBII, but when youtube are forced to hand over their entire client list to the authorities (as happened recently), I can't help but begin to get very nervous.

ive added many stones footage to my favourites and after a while they were slowly removed.

i just added them back in weeks later, but the rate at which they got deleted was getting faster.

now i dont bother, i know where to find these videos anyway, but it is annoying when your wanting to listen to a partilar song and cant get access to it right away.

Re: ABKCO had youtube remove my 'Satisfaction' video

How about, as an experiment, someone put up some footage of the Stones (I don't have any) and list them as whoever - let us know for sure so we can watch it - just to see what happens.

As in, see if ABKCO or whoever notices. Like that Satisfaction one, one you know has been told to cease har har...

I'm only guessing because they're looking for ROLLING STONES or THE ROLLING STONES or THE STONES but not, say, The Monkey Weasels or something silly and or stupid. Nothing obvious either - The Rolling Bones or any of those stupid shit names some people come up for our fellas.

Right? Or is there some magic program out there that searches as, for instance, an audio and or video flag, some kind of recogniser? Does that make sense? I dunno if I make sense sometimes. Heh.
