Zeppelin, others Sues WolfgangsVault

There is an article in todays Los Angeles Times business section that Led Zeppelin, The Doors and Carlos Santana are suing the guy that runs wolfgangsvault.com over copy right infringement. Sorry, I'm not computer literate enough to post a link. But it's latimes.com.

I kept waiting for a big trial, it's remarkable they've got away with uploading those recordings for so long.

Yeah it was probably too good to last.

Another thing. KBFH did record the entire Wembley Sep 9 1973 show, right? Hopefully we'll get to hear that before WV closes...if it does, of course.

Think this will be a very interesting case IF it ever goes to trial.

Bill Graham was a powerful force in the music business, and if he were alive today and owned and ran the Wolfgang Vault business there'd be no lawsuit. Even though musicians might grumble they wouldn't want to take him on.

Fact remains most of the diverse products" from the "Vault" violate all sorts of copyrights, and I would think, in some cases, performers contracts to appear for Graham on such and such a date.

I knew Graham and have mixed feelings about how he did business and used his power influence. There was a decent and sensitive, considerate Bill, among with several other personalities.

So, legal experts amongst us, how does radio broadcasts fall under the domain of artists' performance rights and ability to claim royalties on such broadcasts?

The Stones obviously never attempted to halt bootleg releases of the Brussels/Wembley broadcasts.

The thing is, King Biscuit has been releasing archived shows on CD for quite awhile. I bought a 1988 Iggy Pop show that was one of these.

So, I get the impression that these specific performances were covered by a joint copyright between KBFH and the artists.

Some of the shows on the site are available for purchase as a download. They say the quality on the pay shows is much better.

I understand that alaw suit against Wolfgang's Vault is very complicated, as Bill Graham was the legal owner of the recordings, includig the KBFH recordings, as that was part of the promotion deal. The current owner of the tapes baught everything from the Graham estate. So legally, he is the owner and can do what he want with it.

As far as I understand, the claims from the Grateful Dead, Santana and Led Zep are not about the tapes, but about the merchendising that is sold on the website. They don't want the website to sell T-shirts with the bands names on it, as that is seen as trademark infringement.

I think this is the main reason why the record industry have to stop it.
Before that, it would probably be difficult to get a decent trial.

Maybe one could see it this way: Wolfgangs Vault is the current owner of tapes and other material, that has been bought from Bill Graham. After Bill's
death his memoirs were published, edited by Robert Greenfield: "Bill Graham Presents.My Life Inside Rock and Out"
I read the book about ten years ago, Bill criticizes some artists for their bad
manners, but the band that absolutely was the worst was Led Zeppelin, there's
even one whole chapter of the book dedicated to them and their crew!
And now they are trying to sue Wolfgangs Vault...
