they DO get busted. Personally, I dont think the BAND themselves are too bothered, but if you're taping, videoing or even photographing any show, you're liable to get your equipment confiscated by security if you're seen. Hence the warning on your ticket about recording.
I think most acts would be relatively ambivalent about fans taping the shows if they were 100% sure the music was just going to be traded without money changing hands.
Many bands are of course "taper friendly" and allow fans to record the shows. The Dead being the best known example. However, that doesnt mean they sanction bootlegging, which is a different market entirely. The Dead have actually gone after and prosecuted people for SELLING bootleg LP/CDs of their shows. Many major acts have done the same.
